avoid auto fraud

If you buy a car that is financed through the dealership, the dealer CAN cancel the contract, but only if it notifies you within 10 days of the date on the purchase contract. It is based on the language of the purchase contract. Look at your purchase contract. That's the long yellow document that says "RETAIL INSTALLMENT SALES CONTRACT" at the top. Turn to the back of the purchase contract, and find the box that says "Seller's Right to Cancel." It is at the bottom of the second column.

Car dealers are in the business of selling cars to consumers, not financing cars that consumers buy. So, this box advises you that after you sign the purchase contract and leave with the car, the dealership is going to find a finance company or bank to buy your contract. This language gives a car dealer the opportunity to find someone to buy your purchase contract. Most of the time this is not a problem. However, if the car dealer cannot find someone to buy your purchase contract, it can cancel the purchase contract. But, the car dealer must notify you within 10 days of the date on the purchase contract. If it does not, then the purchase is final and cannot be cancelled. Every purchase contract relating to a car purchase in California that I have reviewed has included this provision in it, and our firm has seen thousands of purchase contracts.

If the dealership cancels within 10 days, you get your down payment or trade-in back. The purchase contract requires the car dealer to return to you all consideration (i.e., everything) given for the purchase. This includes your trade-in vehicle. If you gave a $2,000 down payment and a car as a trade-in, the car dealer must give you back both the $2,000 and the trade-in when you return the car you purchased.

Sometimes a car dealer may tell you that it already sold your trade-in, and will offer you the value of the trade-in as listed on the purchase contract. The language of the purchase contract does not appear to give the car dealer this option. It requires the return of the trade-in. However, if the car dealer does sell your trade-in, at the very least, you should tell the car dealer that it has to give you whatever is the highest value for your trade-in out of either (1) the value of the trade-in as listed on the purchase contract, (2) the fair market value, or (3) what the car dealer received when it sold your trade-in.

The car dealer CANNOT charge you for using the vehicle you purchased from them. For instance, it cannot charge you for the miles put on the car during the 10-day period. However, you are responsible for any physical damage to the car during the time it is in your possession.

If the car dealer exercises its right to cancel the purchase contract within 10 days, you are not required to sign a second contract to purchase that same car. Let me repeat this. A car dealer cannot force you to sign a second contract. If the car dealer cancels the purchase contract with 10 days, you are obligated to return the car, and the car dealer must give you back any down payment or trade-in that you gave with the purchase.

The car dealer cannot cancel the purchase contract after the 10-day period has expired. If a car dealer tries to do this, you should advise it that your understanding is that the car dealer is no longer entitled to cancel the purchase contract, and ask the car dealer to send you a letter explaining why it thinks it can still cancel the purchase contract.

The wife and I purchased a new Yukon and traded in our tahoe with a lien a against it. The dealers still has not paid off the trade-in like they were suppose to. The first time they mailed the check to my house with the wrong bank name on the check and wrong account number. I called the lienholders which was Citi-Financial and they said they would not be able to cash the check since it was made out to Citi Auto instead of Citi Financial Auto and the wrong account number as well. So I called the dealer they told me to bring the check in and they would correct the mistake. It has been two week since I have brought the check back. I am already late on the car pymt for the trade in now and about two be two months behind all because the dealer is taking is sweet ass time. I have been talking to the lien holder on the trade in and they told me if they do not receive a pymt by JUL 14 it will make my credit look bad. Do I have case when dealership ruins your credit all based on no organization and professionalism. The wife and I are going to buy a house in a year. If this prevents that I will sue. Do I have a case.

I would just like some advice on this situation that I am dealing with. On Saturday, June 3rd 2010, I purchased a used 92 Lexus ES300 from a buy here pay here lot in Columbus, Ohio. I put 1200 down and paid the taxes and title fees. In total I paid them $1575.00. Before purchasing the car, I had tests run on it to make sure that I was making a wise decision because I am a full-time college student at OSU and this is my last year of school and of course, being a full-time college student I have very limited financial resources and I just don't have the time or the money to deal with my car not working properly. I felt comfortable about buying the car so I went ahead purchased it with the agreement that I would make payments every two weeks on it. After purchasing the car, I took it straight to get the oil changed and was informed that I had a bad oil leak. This was not even an hour after I drove the car off of the lot! I immediately called the dealership back and he advised me to bring the car in today, Monday June 5th, for them to take a look at it and fix it. A couple of hours later, while on my way back to my apartment, my sister notices that the temperature gauge is suddenly increasing very rapidly. Luckily I was really close to my apartment so I made it home and parked the car and of course, immediately called the dealership again to notify them of this. It was after business hours so I received no answer but I have since left several messages and have had no reply. Im guessing that they have been closed because of the holiday. My brother told me that it was probably the radiator or the thermostat but I recently dealt with a car having a horrible oil leak and the engine blowing on me. Like I said, I am a full-time college student and I need a good reliable car not a car that I have to constantly worry about. I would really like to return this car and get a refund. Is this possible, especially being that I was experiencing and reporting these issues to them only a few hours after I had the car? Any advice on how to deal with this would be extremely helpful.

My car was making a noise so I decide to get a new car. I went to the dealership and found something I liked. I told the dealer my car was at the repair shop getting checked out for the noise. I told him I could think about the deal and bring over my trade in the next day. He wanted to close the deal right then so he said he would take the trade in sight unseen or as is if I did the deal right then. I agreed. I signed all the paperwork and left. I got a call from the repair shop and the repair was more than we imagine. I called the dealer to tell him but now he was to redo my paperwork and take back the trade-in amount. Can he do this? I wanted it as is! He knew up front there was a problem.

I took it to a mechanic to get everything fixed an he sd my truck needs alot of work, from everything I mentioned to Front main seal, Transfer case seal, all front end work, fuel pump, fuel gauge, AC cuttin in and out and dangling wires. So, I drove it to another Mechanic 2 months ago to do all the work an the transmission locked up. I don't know what to do and I need help? What are my rights I know it's been a year but it hurts to keep paying for a vechicle that we can't drive. I've asked a lawyer an they want 1,500. down with 100. an hour. Question comment back asap, im pretty sure i already know the answer but a little experience never hurt, i went to the dealership and bought a truck and got it for 12300 i put 2000 down and then signed up for an optional 3rd party warranty, i thought it was a good deal when i got home I went Pre-Law and read everything and discovered that to continue with the warranty i would have to change the timing belt at 60000 as well as regular oil checks, the cars at 51000, so im decided im against the warranty and worse case scenario the money that would go for the warranty could just go for repairs, my questions is i have already signed all the paperwork with the exception of the loan agreement, am i legally binded to the contract or should it tell them to redraw up the paperwork. confirm my expectations,

Most extended warranties allow a flat cancellation within 30 days of buying it. That means you get 100 % back. However, if you financed the warranty along with the remainder due from the sale - which I'm certain you did, the refund goes to the lender. After all, they loaned you the money. The $2000 you gave as a down payment has nothing to do with the extended warranty it was part of the purchase of the truck. BTW, you really need to listen to them about changing the timing belt at 60,000 miles, it's no joke if the belt fails and it will. Changing oil every 5000 or so is a good idea also. Extended warranty like insurance is good when you need it. Otherwise it seems like money down the drain. It's always a gamble.

insurance question

I bought a used car from dealership. I signed the papers a day before going to vacations-long trip to other part of country. Proof of insurance got from new insurance company. I told them (insurance company and dealership that I go for 2 weeks vacation-tomorrow). As it turns out my insurance that I got didn't covered a collision, only comprehension. The dealer was in contact with insurance -they exchanged phone calls-so they completely understood this luck of coverage. Next day I had an accident (brush with animal, slide from highway, totaled a car). Dealer called me next day at home (after accident, when I waqs on the trip) and left message that I need to add additional insurance. I already had an accident. Insurance refused to pay, proposed lienholder refused to finance, dealer is suing me for a breach of contract. Dealer insurance agent send me papers: 1/ that I give them power of attorney to represent myself; 2/ that I include in the title dealer as lienholder. Now dealer suing me as a breach of contract. Send interrogatories. insurance never investigated a case, they send me half year later a response, that I do not have proper coverage.
Any advice?

On 6/11/10, I traded in a 2006 Ford explorer for a 2010 Ford Fusion. When I signed the areas I was asked to sign I wasn't sure what a particular portion of my contract said, but I did not worry because I was not asked to sign that particular section. However, when I got home, I looked over my contract again and realized that the cost of the section I was unsure about was in fact included in the total final price of my contract, even though this portion of the contract was explained to me and I did not sign this portion of the contract. Yesterday, I was to come in today to rewrite my contract for a lesser term, smaller payment, lowered vehicle price, and 0% interest. Except, there was no mention of the portion of the contract that I did not sign. I went back today to meet the rep that wrote my contract but he was not there. He left my new contract with someone else.
Apparantly, the company that was to finance my vehicle, did not accept the original deal. So, the new terms changed to : 60 payments instead of 72, 0% instead of 1.9% interest, total value of contract from about 36K to 32K, and last but not least my payment went up not down from $508 to $540 a month. Still no mention about the part I did not sign.
I finally had to ask myself about it. This section in the contract was for a maintenance package, and an extended warranty package that I knew nothing about. That is not all. The cherry on top is that the rep that wrote up my contact signed my name twice on it, and did not even ask me if I wanted it or not.
Can someone please give me some advice on what I should do? Should I report the dealer? How can I use this to my advantage? Please help I only have a few days left.

They said they will try to get me pre-approved, have me sign all these documents, w/high rate 22%, pmt at 500 on a 2008 20,000. vehicle worth 23K, (actually worth 20).

Today - dealer calls, that Im approved, they will need more tan 7K down, and i can get the car 2008. AGain, i tell him, i told yoau and we agreed wed/thur i do not want a 2008..... now what do i do?

I want that paperwork destroyed, and start w/approval amount, and get a new car for 20K or less, withmy 7K down. financing 1 ...3K w/lower payment - IS THE PAPERWORK I SIGNED LEGAL AND BINDING? i GAVE THEM 0 MONEY DOWN AND I DO NOT INTEND ON GETTING 2008, ANY HELP WILL BE APPRECIATED ON THIS DOCUMENT.

well here is the thing... what this dealer more likely did to u was when they sold u the car they took out a loan of their own on that cars title. then they owed money and that bank they took the loan from has a lean on the title and they can't get it yet cause they haven't paid the bank back. you was riding with this expired tag that didn't even make it to dmv because they had no title to send in with the paperwork.. contact a civil attorney and explain the situation that i gave u and he will investigate the records of the business by court order and if said is true in your case then u have a fraud issue and u can get your money back. my question to u is who repo'd the car then if the bank doesn't have the title because they couldn't put a repo order out with out proof of the lean or co-ownership.

On May 22, 2010 I signed a contract with Nelson Mazda for a car. I was financed through a bank in TN. The dealer asked for $2500 down payment and I agreed thinking I could get the money from my 401k. Well I wasn't able to get the money so I called the dealership and this was after 10 days to let them know I wasn't able to get the down payment. When I was in the dealership they said when the bank calls tell them I put down the $2500 when I didn't YET. So I did and didn't think anything of it. The dealership gave me until June 24, 2010 to get the down payment. I gave them a post dated check. No. The dealer made a big mistake when he told you to lie to the bank regarding your down payment. Most lenders frown on hold or post dated checks and if you were to default on the loan, the bank would force the dealer to buy the car back. The dealer probably won't come after the car. Pay them the down payment in pieces if you have to.

Three weeks later he calls me back and says that I agreed on an additional $500 down payment. I never agreed to that, a promisary note was never signed and the car had been fully funded at that point. Now they are trying to force me to pay somthing that I never agreed to. Contact the BBB this is concidered frud, if you never agreed to aditl deposit then they re worked paperwork without you knowing if there is no notes or anything you agreed to than it's fraud did you read the entire contract before you signed it?? They could have put a clause in there saying more deposit , however you were supossed to be notified reguardless, The only sticky part is if it in the new contract and you didnt read over it. However I would still contact BBB they handle people and companies like that, they will tell you your rights as well :-) hope this helps

I went to buy a used motorcycle from a dealer. We worked out financing and I went to the bank and signed loan papers. I never signed a purchase agreement for the bike. Was told I could come back in a week and pick up the bike. Went back, they don't have a legal title for the bike, they say they can't sell it. They have none on the lot near it in price. I told them I would go somewhere else. Now the bank that they financed me through says I have to pay $250 in loan fees. They had not sent the check to the dealer yet, the VIN they had for the bike as security wasn't even correct. Do I pay those fees or should the dealer?

On 2-23-2008 I was asked to come intoi Grossinger auto here in Chicago to co-sign for a friend on a business deal. I did and we drove home in a 2005 Chevy Cobolt. I went to Iowa after that and my friend kept the car. I was maild a contract DHL to sign for a car for myself, filled it out and sent it back in the return DHL envelope. I was called to come in to pick upa 2008 Toyota.

When I got into the dealership @ March 8th, the delaer told me they didn't know why I was there and didn't know what to tell me! So I left upset and went on that Monday/Tuesday to another dealer and got approved for a 2005 Dodge. 3 weeks or so I came to find the dealer had taken back the car from my friend and gave my friend the car they called and told me to pick up that they said they didn't have.
I don'nt know what happened to the Cobolt and nor why would they lie to me.

I winded up being stuck with two open car loans as well as repossessions! I am suing them now for consumer fraud. If any knows a a probono lawyer let me know.

I purchased a Jeep Commander fully loaded for the sticker price of $45,500 on Sat 29 May 10. I was told that I would get $6500 in rates, which would handle my remaining payments on my lease ($5300). My credit rate is at 600 and I was told that I would have an 11% interest rate on the vehicle. Now my math may be wrong but isn't 11% of $45,500 approximately $5,005? Simple math would be add $5,005 to $45,500 and I should have a total car purchase of $50,505, correct? I wanted payment under $550, which may have been unreasonable but to make a long story short, the dealer said that because of the banks interest rate, I would have pay $823 for 84 months. So I'll actually pay $69,132 for the vehicle vice $50,505. I felt that I should have only paid $601 for 84 months and that was only if I decided to pay on a vehicle for 84 months. Is there something wrong with this picture or is this process correct? I'm going in to discuss this with the dealership, who refuses to answer my phone calls today, 31 May 10, and see if they will review the facts with me. Can someone school me before tomorrow?

This has been well over 10 days since he bought the car, going on 3 months now, and we still hardly have any information. We just called Mazda again yesterday asking what is going on, and they said that if we want to, he can bring the truck back in and they will give him the entire down payment back, a total of $2,500, and find him something else that they can qualify him for. What is going on and what should we do? More so, what are the laws pertaining to us having this vehicle so long without them getting him financed? It's not like we are trying to buy a luxury vehicle either. The loan was for $14,000 after the $2,500 down payment; fairly inexpensive for the truck that he purchased, a 2007 Chevy Silverado. My husband needs a reliable truck to get him back and forth to work, and I don't imagine they will have something of that quality for less than $14,000 if he takes the truck back. What should we do?

Carmax-returning the car

I bought a car on Mothers day just 24hrs after dealing with my car being stolen. I went in and found a car at a decent price I Could afford. I gave them $1500 down and all of the documents they required for the transaction to take place. I walked about with the car, contracts signed. 5 days later I get a call from one of the sales associated, telling me that my loan was not approved because of my lack of proof of "income". I am self employed and do freelance work with different brands and marketing companies. I provided them with all my contracts, W-4 checks ect. So I did not hear back from them, I faxed additional verifiable income. Two weeks later after the fact I get a call from a Sales Manager. He stated I need to come back to Carmax, return the car or try to get finance again through the same credit company, providing all of the documents again and I would have to give 30% down, which is another 2000K. He stated most of the time if somone puts down at least 30% of the downpayment the finance company doesnt event look at the income, which did not make sense to me and I stated that. He said it isnt a guarantee but they can try again.

So my question is. Its been past the 10 days, and since Carmax was not financing the car, that law doesnt apply to them correct. I was reading the fine print on the back of the cotract and the only thing it stated is that i have 5 days to return the car if I am not happy. At this point I rather just turn in the keys and get my money back and just by a car cash then to deal with this mess again.

I think they inflated mu montly income, and I would put a significant dowpayment down. But because my verifiable income comes from 20 different agencies, and i dont have 1 source of income it was hard to find a lender that would approve me.

any thoughts?

I just bought a used 05 Honda Accord on Saturday. On Sunday the car would not start, i called the salesman and he wanted me to find a tow company to tow the car into the dealer. I told him that i was not my responsibility to do that being that i had didn't have the car 24 hours. The dealer called yesterday and said that the bank didn't approve my loan at 9% interest rate that they wanted to go up to 12%, which would make my payment go up. They said if i do not sign the new contract that they would just buyout the original contract and i am stuck. Can they do that or are they just trying to jerk me around to keep the car???

The loan i have with the capital one is still active, and i have the possession of the title, and the pink sheet. How can this be possible, and what do i need to do press charges, and cancel the loan from the bank??? Someone please help me.

here's what i think about your car getting repoed. you applied for a loan at CapitalOne auto finance correct? they sent you a blank check to pay for your vehicle purchase correct? so you bought the vehicle and payed withe the check correct? so the dealer you went to and bought the vehicle deposit the check. now CapitalOne found out that they don't deal with the dealer where you bought the vehicle from or doesn't deal with them anymore. they will now cancel or return the check from the dealer. dealer will now look for a bank or someone who can purchase your financing. more than 10 days after you purchased the vehicle and they cannot find someone to finance you vehicle. they have no choice but to get the vehicle back from you.

i am not sure if that's legal for them to do it without notice. so try and get some more info. i'm searching aswell since i have the same problem. though i still have the car. CapitalOne told me that they cancel and don't deal with the dealer where i bought the car from. it's been already 15 days since i bought mine and i know for sure that they can't get someone to finance it.

My husband and I paid for a truck on Monday in Philadelphia, We went to the the titling place with the dealer and they could not issue us a tranisit tag becuase the title was still in the name of who ever the guy bought the truck off of and it was a salavage title...Something he did not tell us about before we paid for the truck. The lady at the title place did what she called a salvage to salvage to take the truck out of the old owners name and put it into mine. I paid and got my recipe. She said that the title would be back in about two weeks. I went to the DMV in Delaware and paid for a 5 day transfer day so I could drive the truck from PA to DE. I have paid for the car in full. I have the bill of sale, I have insurance on the truck and I have paid for the title work in PA. I even have a temp tag for the truck for Delaware. I went to go get the truck and the dealer will not let me have it. He said that because the title is still is his name I can't have it. The title was never in his name and it is being put in my name by the PA DMV. I paid for that and have the recipe. When we asked him to either give us the truck or our money back he said that we could have our money back but we would have to wait for the title to come back in my name sign it over to him and two weeks after that he would give us our money back. What can I do?

I leased a 2010 VW Jetta on May 11. While I was driving it home I noticed the drivers side window had a lot of air coming in, and the check engine light came on. I took it back to the dealership the next day, and was told they would have to keep it to run diagnostic checks, and order a new window seal. 24 hours later they still have not diagnosed the problem, and also said the window is 50% better. In the interim I received the contract in the mail and noticed the dealership did not sign the contract. At this point I do not want the vehicle, but would be open to trading for another, perhaps a different model (I would still give them the business, just want a bigger vehicle)

My question: Is the contract binding without the lessor's signature? Can I cancel based on this oversight?

I took possession of a car from a dealership on Saturday. Now it's Thursday and I'm not entirely happy with the way the deal is going. They claimed I've been rejected numerous times already by various banks but they promised I'd get financing through their own bank which is what they'd told me originally that I'd be financed through. On top of that, I admit I fell for the usual salesman antics when considering getting the car. Their bank hasn't approved yet and I'm supposed to have an interview with the bank rep this coming Saturday. I have given them $1800 down, with a another $500 promised for next week. I also have not given them my old car yet which was to be part of the deal. I REALLY don't feel at all happy about the way things are going and I'm wondering, is there any way out of it at this point? I'm considering telling the bank rep this Saturday that I just got notified I'm going to be laid off soon so she won't approve the loan. But can i still get out of it without making up stories to the bank rep?

Dealer does not have the tittle

I bought a BMW M3 2002 on my local BMW dealer, I gave then a trade with clear title in for the half of the value and the other half will be financed by BMW financial services.
Now 20 days later the dealership still can't get the tittle, they said it was a consignment car and the old owner can find the tittle, we really like the car we closed a decent deal.
They suggested we sign a new BMW contract when the title appear, but I am afraid they may cancel the contract before the 10 days.
I am also worried about the situation, because they can't find the tittle, what my options are, what I should do, what will be the best way to deal with the situation.

I put a down payment on a 2007 Honda Accord 10 days ago. I don't have the car in my possession but the dealer does have my plates for the vehicle. I did speak to the finance manager on the 6th and was told to give him a half hour or so because he was waiting on the bank to get back in touch with him. I never heard anything from this man. I then proceeded to call him back - no answer. I then called the sales consultant who told me that he did speak with the finance manager who asked for copies of my recent pay stubs. I forwarded that to the finance manager this past Friday. I have the retail installment sale agreement but it's not signed by the seller and the only signature is mine. I also have the motor vehicle contact which is signed by myself and the dealer representative. Am I out of luck with this entire situation?

Well I wanted to return the car at this point so I never signed new papers. I then get a letter stating that my loan was in default. Well The bank that denied me put my loan through from the date I was originally denied making it 3 months behind the same day they approved it. They sold my account to another company immeadiatly. After I talked to this company I found out that the income amount on my application was inflated by about $32,000. Then they showed up to repo the car.

I used to work for a large bank in collections. This is a very common question for people who do not understand banking. Basically you bought the vehicle for 23250.00 which you say included taxes and doc fees. If you add on 2k for the extended warranty and then 750.00 for gap ins. it is exactly 26k. I would have to see your exact contract to know.for sure But if you traded in a vehicle that you owed more on than they allowed they sucked up your 1580.00 in the trade in. This is a very common practice by Auto Dealers to get your new purchase funded and they get more money. You signed on the dotted line so that does make you liable. (unfortunately the Auto dealer did this without you knowing it and likely told you here is the price and the rest is just "mumbo jumbo" . You sign cause the price is correct at the top then you realize later that it isn't right on the bottom. The bank that financed you has no knowledge of the actual transaction that took place between you and the dealer. They just know that the bottom line is within their guidelines. You should have the actual contract or a copy of it in your paperwork. It is called "Note and disclosure statement". On the right hand side it should completely breakdown what you are paying for. Both the extended warranty and the gap ins are refundable. You can cancel them. If you look at NADA.com and select what model you can find out what your car is worth. If the value is more than your loan cancel the GAP as it will not do you much good. (your primary insurance would pay off the loan less your deductible and the gap would then be a waste of money). As for the extended warranty, Since this was a loaner it was likely beat on hard and you purchased it used with a limited warranty most likely. I would keep that and hold on to it like it is gold........ If the transmission or engine goes it has paid for itself. If not then the piece of mind for the next couple of years is worth every dime. But if you really do not want it then cancel it. Be aware that if you cancel these items the money goes to the lender who then takes it off the total of your loan. You will not have a reduced pmt. but you will pay for a shorter time and you save a ton of interest because the principle is being paid faster than it originally was suppose to. If you want a lesser payment refinance with the credit union. They are the best anyways. (I didn't work for a credit union.) I hope this helps

Then if she signs it willingly he can get his own financing and relieve her of this debt that she probably shouldn't have anyways, since it sounds like she has enough on her plate.

The dealer called yesterday (5/2/2010 -19 days after the contract was signed) and stated they could not get me financed and to bring a family member to co-sign or bring the truck back. I asked about my trade-in that was paid off and they stated they are "stopping payment" to Ford Credit. Can they do that?

I know I can return the truck and get my trade-in back, but according to the "10 day Seller cancellation" wording the dealer can no longer cancel the contract.

My question is; Can I keep the truck and make timely payments directly to the Dealer? I have no idea what they did to my trade-in and I really don't want it back. I'm also getting the feeling if I do go to give it back they will present me with a last minute approval at a higher interest rate. I want then to honor the contract we signed.

I think you will be pleased with your results. Also do some research online about this there is a ton of info on the internet on how many days they had to rescind the contract. If they will provide you that find out from your state "attorney general " (consumer rights dept) if it is legal at this point. Also look through her original documents to see if there is anything there. If they refuse to provide it to you in writing likely it is not legit. I would then file a legit written complaint with the Attorney Generals office and they will likely handle it for you.

I called the warranty co. next day; they said I had 30 to cancel but since they hadn't received paperwork yet I would need to do it through dealership. CAlled and asked for supervisor of financing guy. I left voice mail message for him to return by call. He didn't until several days later. got to cancel contract through him. A week later, originally guy called saying I needed to redo contract showing I had canceled and what new balance would be. Week later, he called back wanting verification of resident address and verification of income. I took in those two items. Had told him originally that I had second source of income. He mentioned only verification of actual employment. another week went by; got a call from yet another guy in financing that I had never talked to. He wanted veriification of 2nd income. He wanted verification of this. Emailed contact to fax info over for the source of 2nd income. I had even contacted bEtter business bureau to see if they could something done; I had been told several different things by all three people that I had talked to. My second source of inocme took care of problem. The first guy I originally talked to made noise about being fradulant on source of income. I had told him first day about sources of income; he asked for only one source of verification. He forgot to write down info on second source. Told him that too. talked to his supervisor about the situtation. One peroon said I wasn't covered by loan yet; the person said I was covered. who to believe. Finally got things worked out after month of them calling me once a week about some problem that should have taken that long for everything to gel. Sounds like most car dealers are scamming new ways to screw people of money.

The ticking or banging that you're hearing is probably piston or valve slap... a condition that occurs when the engine is cold and the piston / valves haven't had a chance to expand to correct tolerances. It's normal and some engines / cars suffer from it more than others. Really nothing to worry about.

Also, it is not uncommon to hear a little bit of lifter noise in the engine when you first start up as the oil pressure isn't built up yet. Personally, I think your justification to lie to the dealer since your pay taxes to "keep them open" is laughable. Are you going to start lying to your bank as well (maybe on a credit application,) since your tax dollars keep them open as well? Do as you see fit, but when you trade a vehicle, its final unless you have a salvage title or something like that that effects title.

The dealers have no problems adding on extra to contracts to get the most for their vehicles. If you are trading in a your car the dealer will inspect it and value it as they see fit. You do not need to tell them anything. They have their own mechanics that can look at the car if they need to in valuing it.

The is a big difference in saying nothing and letting them do their job and lying. If you were to tell them you have just put a new engine in the car and its perfect then that would be a lie. Just take your car in and see what they will give you for it. It will probably be less than you can sell it for privately but requires less effort on your part.

You can report them to the State Inspection license dept. As a dealer the inspection must have occurred within the last 30 days prior to the purchase. Take your vehicle to a reputable inspection station and have them provide you exactly what would not pass inspection. As a dealership they are likely reporting you to the credit bureau. I would go to freeannualcreditreport.com and get a copy to see. Or you can actually call the credit bureaus that are most prominent in your area (experien, transunion, and equifax most likely) look them up online. Then you will know for sure.

Sorry to hear about your bad purchase experience. If it were me, I would contact the local or state dealer board about them cheating the inspection process. Other than that, you decided to purchase the vehicle you ended up with, so the fact that you wanted another car doesn't really matter now, nor does it give you a legal recourse to get out of the deal you signed up for. Sounds like you bought an AS-IS vehicle, so more than likely like your only recourse is to check about them cheating the inspection and MAYBE get better tires and alignment out of it.

p.s. Most in house financing is not going to report to the credit bureaus on a regular or monthly basis... If you do keep this vehicle till it is paid off, you will probably need to pressure the dealer to report it, as it often is never done.

First, Im sorry that you had a negative experience. Unfortunately, Its the reality at most "no credit check" dealerships today. What most people do not understand is that for you to get the car you want, you must first qualify. There are other factors that come in to play besides credit and wants. It sounds similar to what I, as a sales person, deal with daily. A customer qualifies for car A with 1000 down, but wants car B which is out of their price range for the loan amount they are approved for. In order to make car B an option, the customer will need more money down to make up more of the difference in price. Most people see that as the dealer picking the car for you, but its the sales person showing you the cars you are approved for. Its simple math, they just suck at explaining it. You do not have to buy the car they are showing you...you ultimately are the one who signs the paperwork. I do think that the customer service needs to be improved on, however....once you sign the paperwork, they do not have to do anything that isnt in the contract or outside of the state and federal requirements. They dont have to give you gas, or clean the car. However, If they promise you something....you do have a good argument. They cannot legally misrepresent the vehicle or terms of the deal. Remember, You can get your own inspection, YOU make the decision to buy, but once you do....its YOUR responsibility to take care of the car. Do you complain to Wal-Mart when your AA batteries die?

Failed smog... not expired... failed!!!

He informs me that he needs my Jeep for a couple of days because the smog had expired. I ask this dealer how this could be possible since I was told that it was smogged the same day that I drove it home. The dealer says there was a miscommunication with another employee and apparently the smog was not done. He also asks if he can keep the Jeep for a couple of days in order to do the smog. I offered to have it smogged myself since 1.) I need the Jeep for work 2.) I was not comfortable giving up my Jeep and 3.) the dealer was about 2 hours from where I lived. The dealer declines my offer and says that he needs the Jeep for a couple of days. I sensed that this was not right. So I contacted a smog shop and asked if there were any requirements to me smogging the Jeep vs. the dealer. Smog tech tells me it's all the same to the DMV. He also tells me that I can find out smog history online. He offered to check for me and I obliged. Long and behold, this is how I came to find out that my Jeep failed smog on the same day that I drove it off the lot.

To fast forward a little bit, I contacted BAR and DMV Investigations. It didn't work out with BAR since the dealer did not give me a refund since I wanted to pursuit the cost of car alarm and battery cost thru the small claims court. Basically, the dealer wanted me to settle and eat about $400 in cost. The DMV Investisgation is backlogged so I'm still waiting on them.

Contract problems

I just purchased a car from a dealership that I previously had a leased vehicle from. I had 6 months left on my leased vehicle and was going through a divorce, thinking I could not afford this vehicle on my own anymore I went to the dealer and asked if there was a way to turn a lease in early with no penalty. I was told there was not, then started receiving calls from the dealership that if I wanted to turn the car in a could as long as I purchased a vehicle from them. I went into the dealership and was told by the salesman that the dealership would purchase my leased vehicle from the financing company as is and I would be free and clear of the car. I asked the salesman what he meant by that, if that meant that I owed nothing on the car and he said yes. Come to find out that the remainder of my payments was financed into my new car contract and I was not told, the payments are on a line that reads "Prior Credits/LSE BAL" I really don't think that is clear and I think that should have been explained to me. Also, the finance manager lied to the financing company about how much I make and said I make double what I make so that I would get the loan. I went into the dealership to talk about my change of heart and was told that they could not help me and to "set the car on fire" since I did purchase gap insurance. What can I do at this point?

i placed an advert that i was selling my personal car. i got so many responses but there was one potential buyer who kept on calling me with this anxiety of wanting to see the car. we arranged and met. he liked the car i was selling it for $2200. he told me that he had $1300 that he he would like to pay up and pay up the other $900 after 2 days. he told me that he was expecting money from a person he sold his old car to, whatever their transactions, that is where my balance was supposed to come from. i understood, we drove to his house he gave me the $1300 and we signed the agreement of sale. the day to settle the balance came and he said he got no money yet, i understood since he highlighted he will definitely give me my $900 after 2days. the day after he sent me an sms saying he failed to get the money so he wants to return the car i sold him and reverse the deal. he mentioned that the person who was supposed to give him the money is giving him a car instead, yet upon agreement i considered this money as my own and i used it for some project and with the anticipation that i was going to get my other $900 am now inconvenienced now, i don't know what to do or say to this person. is it me or him who is allowed to terminate this contract because all i was looking for was money out of my car and do something else with it not to be told to look for money that i have already used up and pay him back. Please help me

Wow I've been reading all these stories,and was shocked to see how many people has the same problems.My father in law boght us a used car on his name from a dealer in Brits (on 4 Feb 2010).Since the first day we got the car I've told my husband that somethings not right on this car,we searched the car for all the possible mistakes and was amazed by what we found.We immediatly took the car back to the dealer the next day and all they've said is that they'll try to fix it,up until today nothings been fixed on this car.We took the car to the AA and they've said to us that the only thing thats 100% fine is the batch and the mirrors!Within the second week (first week for us,cause the car was with them at the garage to be fixed), we called the bank and they've said that we're too late to cancel the deal,ive called the RMI and they've said that we can either ask them to buy the car back or they must sent it to a VW dealer,but he also refused to do any of these two.So now we are sitting with a 2007 VW Polo and R90 000 dept,which we cant even use to go to PTA with.Please if anyone knows what to do where to go and who to see...Help me!

I bought a BMW 328i 2008 and negotiated for way under bluebook providing my own financing. The bank I was using charged a fee of 12.25% to the dealer. I ensured the dealer knew about this while negotiating. We finalized a price on the car, a fair amount on my trade in and I came out loving the deal. In the sales contract there was no listing of the 12.25% fee my bank was charging the dealership, but the interest rate moved up by .06% increasing my payment. I inquired if the change in my interest rate was to cover the fee and they said Yes. We signed this deal on 3-24-10. The dealership called me on 3-30-10 and asked "me if I could come back down to the dealership with $3K for another downpayment and sign a new sales contract increasing my payment by $37.00 on a monthly basis." I let them know I already signed the agreement last week and was not going to renegotitate the deal.
They called me again today (3-31-10) and advised me they called me w/in 96 "business" hours as our contract reads 96 hours they have a right to cxl the contract if they can't find financing. I let them know it is 96 hours in the sales contract not "business hours" as they were open every day a and they can find financing as I spoke with bank and they are ready to approve loan.
The Finance Manager and GM then called me and asked me on 3-31-10 and asked me to bring the car back as they don't do deals to not make money. They said I took advantage of them as they are used to selling Fords not BMW's and I negotitated an unfair contract. I asked them to show me legally in my contract where I need to adhere to what they were asking and they told me they could not and that they would have to get attorneys involved if I "wanted to play this way, and not a create a WIN/WIn for them"
My question is....do they have any rights here? From the contract, it reads they have 96 total hours to "unwind" the deal. Can I be on the hook here for negotiating a good deal? It doesnt make sense. If I wanted to take the car back 2-5 days after purchasing I could not but if they want to even thought financing is in place, they can? If anyone has any legal advice, pls help! we live in Washington state and this transaction took place in washington.

It is illegal to sell a vehicle over the list price. Thats why they must also have them posted somewhere accessable...ie in the car or on the wall. However thay can change the list price...before a sale/agreement. Id have the secretary of state take a peek at the situation if they try playing this game. Odds are....youre not the first, and there are probably other skeletons in the dealers closet.

I used to sell cars, and when this sort of thing happens it is basically because someone in the finance department dropped the ball. They make up stories to get you to resign so their dealership doesn't lose more money on a deal or get flagged by their banks.

I am going through this currently, and I told them I used to sell cars so I'm no fool! If they "unwind" a deal, the new car becomes titled as a used one and depreciates tremendously. I have asked several times to have something in writing and nothing has been provided. I would contact the bank personally to get the real story. If you are the person on the contract there is NO REASON the bank should not disclose information to you on YOUR OWN contract.

Auto Fraud

I think i've been had. I'll try and make this short and sweet. I puchased a 2004 Cadillac Escalade with 31,000 miles for 18,500 (should've been my first clue) from a dealership. I asked if it's ever been in an accident, flooded out, mechanical problems etc, they said no and provided me with the carfax on the vehicle

I got instantly approved from Credit Union in the neighborhood who then cut me a check on the spot.

I brought the check back to the dealership where I signed the sales paperwork and handed the check over to them. The dealer placed a tag on the car and that paper in the window and said after the fact that the car is mine but I need to bring it back in the morning because a trooper has to look at the car. They do inspections as well (also paid for) and they noticed that the VIN plate on the door was missing and before I could get the inspection stickers in the window that a NJ state trooper had to inspect the vehicle. I thought that was fishy, but I was too caught up in the moment and agreed.

I didn't bring the SUV back the next day and the dealer called me up frantically the following week saying that it was imperative i bring the car back in immediately for the trooper to investigate. I bring the car back, and the dealer gives me a loaner car (A 2006 HONDA PILOT) in the meantime while they sort out the VIN issue and attempt to get my title.

It's been a week now and my Credit Union has still not received the title from the dealership and I still have the loaner car in my driveway not to mention see my car in the dealer lot everytime I drive by.

The dealer calls me up yesterday and says it's going to take a little while longer because they are having a hard time getting a title for the vehicle because now he says the state of NJ issued a different VIN number to the vehicle (is that possible?) and that the credit union will not hold a lien on that title and that I would have to look into obtaining a personal loan (mind you i checked with the Credit Union and the check provided to the dealer was cashed just a week after the purchase). Needless to say I'm pissed and explained to the dealer that I will meet with them to discuss options.

While getting my paperwork together, i noticed on the bill of sales information that wasn't on the original sales agreement i thought i signed.

There is an AS IS disclaimer not checked but the box underlined subtly on my copy stating This motor vehichle is sold AS IS without any warranty either expressed or implied (Yet I paid 2,000 extra for the Preffered members warranty listed on the document) I find it weird that the USED CAR WARRANTY above the as is was not checked stating im covered with a limited warranty which they gave me the impression.

Also, the warranty on the original document i signed stated 36 month for 45,800 miles while on this document it says 24months with 25,800 miles. That was the original warranty offer, but when i said thanks but no thanks the dealer graciously offered to increase the coverage to a 3 year warranty.

Bottomline: I no longer want this car and have the following questions?

Can I return this car with expectations of getting a full refund?
What would cause a credit union not to back a lien on a used car just purchased?
The carfax for the vehicle came back clean but is it possible that the vehicle was stolen, salvaged, or misrepresented in a way that the dealer didn't disclose?
What are my rights right now?
The dealer still has possession of the vehicle for the past ten days, should I be concerned with that?
What are my rights as a consumer? Am I protected under some law somewhere?
What should I do next?

The credit union cut a check for the entire price and it was cashed....then the dealer cannot make you bring the car back as its no longer theirs, and they are not the lein holders. The car has no more business being at their lot. Also, There is no VIN plate on a door, its a sticker. And though shady, its not always bad when its missing. The door could have been replaced at one point in time, or a curious five year old could have peeled it off. Unless the vehicle is stolen or used in illegal activities the "trooper" would have no business with it either as the Secretary of State Police have jurisdiction over it otherwise.....until its sold. Now....only what you signed is what binds either party. They cant add anything later. Sounds to me like this dealer is pulling the wool over your eyes. Maybe seek legal counsel.....that dealership is a bunch of crooks.

Extended Warranty on used car

They finally got a decent interest rate with Chase but they told us that Chase required us to purchase an extended warranty on the car. The warranty was an additional $1900. Son paid cash for 1st car~ needs new engine after 24hrs

My 19 year old son shelled out $3400 of his hard earned money to buy a 1999 Subaru Legacy from a local car lot. He paid cash for it and drove directly to valvoline to get the oil changed and have it checked out. At their suggestion, he returned to valvoline the next day to have the transmission serviced. After having almost all fluid drained, the valvoline employee asked my son to start the engine and it wouldn't start. They proceeded to push him out of the shop and told him to contact the dealer. This all happened within 24 hours of my son purchasing the car.

We called the dealer who sent a mechanic out. All he did was try repeatedly to get the engine to crank. It sounded AWFUL! Then he handed me a copy of a news article telling me that I bought it AS IT. Then he left.

I had it towed to a mechanic who informed us that it had "jumped timing and bent the valves" and we need a new engine.

Now I have been told that Tennessee's Lemon Law pertains only to new cars and the dealership has no responsibility to make this right. I would think that they would WANT to make the situation right. After al,l we live in a small town and what does it say about them both personally and professionally if they don't? If they don't have a legal obligation, I would think that morally they would feel the need to fix this.

Does anyone know if I have any recourse?

I took it to the dealer 5 day later to have it checked and told them I felt unsafe maybe it need it a wheel alignment but it was late so they only gave me an appointment to bring it in the following week, so a week later at the dealer they said the car is fine there is nothing wrong with it they test drive the vehicle on the freeway over 60mph total of 5 miles and said “Vehicle does not wanders it just feels like it wanders due to the sensitivity of electronic power steering system” 18 days later I still feel unsafe and feel its not the sensitivity of power steering and have doubts about the car; now its starting to make a noise inside somewhere on the dash board can I return it or ask them to exchange it for another of the same make and model that feel safer.
the fact that I am a female it feels that they can just take advantage and give me the run-aroung because i dont know what my rights are.

I purchased a 04 Chevrolet Silverado on Feb. 10, or so I thought from Corona Autoplex. Two of my credit scores are 694 and one is 749, I was pretty sure that I could get a good deal. The contract dictated that I put 3,000 down and receive a 9.9 APR. The truck has a large lift so I also purchased Gap insurance. I drove the truck home thinking the deal was set. Thirteen days later I received a phone call from the same man saying that I was not able to be financed through Wachovia and that I would have to find my own financing. I have already invested over 800.00 for an alarm. I have been approved for two loans (Road Loans @ 13.49 APR and Capital One @ 14.70 APR). These companies, according to him are conveniently not accepted by Corona Autoplex. I have no idea what my rights are at this point, I want to keep the truck if at all possible. I am just an honest Veteran trying to buy a truck for work! Please help.

They asked for 3 checks, problem was they did not want to take our temporary checks for payment dated diffrently to make 30 days total for the down payment of 1400 dollars. We said forget it and went to leave. They said no we will work with you but bring in cash only and when the bank calls you for the welcome survey tell them you gave us cash and did not give us postdated checks. My husband said ok. We talked to the bank and we are financed through AmeriCredit. I have not given them the 1400 dollars yet because they want cash no debit card or money order the man said he needs the cash in his hand. Problem we live about 45 min. away and I work some crazy hours. I keep asking him to take a depit or a mailed money order and he will no accept. On the contract it said we already paid the downpayment. Is he trying to make some cash for himself or what. I all seems fishy to me. I feel like telling him to take 500 and call it good what shold I do.

They don't want you to tell Americredit or any other lender that you haven't paid the downpayment because lenders require downpayment be made prior to the vehicle leaving the lot. Maybe if he is requiring cash, there is something on your credit report that concerns him to not accept other forms of payment. Either way I would make sure to get a receipt for the transaction and make sure that you keep good records of the cash. On my downpayments when my credit used to be lower i would always pay by check. However if you felt skeptical about the cash demand then you should not have continued your business with that dealership. An approval is an approval and you could have walked into another one and let them know to contact americredit for your approval that you have already received and then worked with that dealer. You can't screw that dealership out of their money because then you are looking at courts, attorneys, and proof you paid and to a judge they are going to say you paid cash without a receipt, that was stupid.. So either way you are going to have to pay! Mayeb this will motivate you to work really hard at cleaning up your credit and then you won't have to worry about down payments.

I would want at least one payment in my hand and cleared before they drove off my lot. But then again I have been screwed a few times. Sometimes the only money your get from a person is what they pay down, so you don't wanna get ripped off on that. My tow truck is the most active vehicle I own because people don't know how to pay.

Well if it say's you already paid it take the car, and when they try and say you didn't pay it show them the contract and say remember I paid in CASH !?!!.

bought a new truck from a monroe louisiana dodge dealer. the day after i bought the truck went to turn on the satallite radio and i was told it was already activated by prevous owner. i was told prior to purchasing the vehicle that it was a 2009 new truck that had 500 miles on it because it was a dealer to dealer trade and it had never left that lot since they got it. i found information in the glove box of a prevous owner from 1/29/10. i purchased the vehicle 2/24/10. i called the prevous owner, he said he bought the truck and he had it about 2 weeks and he took it back he also said he paperwork hadnt been completed, he also said he has the key to the truck. i only recieved one key when i took the truck they told me the other key was damaged and they were ordering a new one. i contacted the sales manager that night 2/25/10 and he denied the vehicle ever left the lot, i told him that i called the individual and he told me he had it for 2 weeks and he continued to deny the vehicle ever left the lot he said they had a sale that didnt go through and the vehicle was never delivered. i told him i contacted to man and he has the key then the manager hung up and called back a few minutes later and said there may have been a misshap and he would check into it and call back tomorrow.
on 2/26 i reported it to the attourney generals consumer complaint devision verbally and in writing, and they pulled up a carfax report and it was listed on carfax as sold 1/29/10. i have that copy. i also called and filed a complaint with the louisiana motor vehicle comission verbally and in writing on 2/26/10. i also contacted the dealership manager, he denied the activity at first then he did activate the satelite radio, i recieved an altered carfax report on 2/26/10 as an attachment on an email. the origional sale on 1/29/10 was not on it. he told me he had a friend that would fix the carfax report. and it was altered. my problem is that i paid a new truck price for a used truck. i did tell him i was going to take the truck back but i was told it was a legal and binding contract and i had to pay for the truck. i do not want to deal with these people thats why i dont want the truck. i would pay the same price somewhere else but it has to be new not used. how do i take further action, this has to be fraud

i bought a suv from a dealer and americredit was my lender. the whole deal went bad. apperently, iam paying 19% plus 7.50% daily on a car that is worth 9,000 back in 2006. i am paying back 30,000 for this suv and didnt even know about this percentages when i bought it. 19% was susposed to be for bad credit and come to find out my credit wasnt as bad as they said it was. go online and look for a auto fraud loan lawyer in your area. they could be found under a civil attorney and stay away from americredit. go on complaints.com and follow the links and you will found out things on all companies.

I recently leased a 2010 maxima at an APR of 2% on Feb 10th and just received a call yesterday Feb 26th to come into the dealer because the lender who happens to be thru Nissan would need to give me a higher interest rate due to my credit score not meeting their level of acceptance for the 2% APR and as a result the payment would need to be increased up to $170 more than what the contract had been agreed upon. Knowing its past the 10 day window is this still possible for the dealer to redue the contract? Its been 26 days since the contract signings and in addtion I provided 3K as a down payment! Can some shed a light here??? Help!!!

Dealer threats cancelled contract

My son and daughter-in-law saw 2 SUV's on a dealers webisite and went to look at the 2 used vehicles one a 2007 the other a 2009. The vehicle they purchased was advertised for $21,800, but during negotiations they discovered on the Carfax report it said there was a discrepancy with the mileage. odomoeter said 22,600- carfax said 36,000+. They asked for a better deal, the salesman came back with a contract for $18,800 they purchased the vehicle all paperwork done, another vehicle traded and tags trasnsferred they left with all paperwork and a temprorary registration. The next day the dealership called and said they had made a mistake and sold the car for too little money and they wanted the vehicle back or an additional $3000. It seems that the dealership totally screwed up- they had purchased 3 SUV's at auction - transposed the price on the 2007 and 2009 and then discovered that the price they advertised the vehicle my son bought had again been meant for a 3rd vehicle not yet on the webisite. They called and threatened to reposses the SUV and then told my son since his wife had not signed the authorization to run a credit report the contract was void. The dealership ran credit reports on both of them without written authorization. The have excellent credit. FICO over 800.

The ending my daughter-in-law, a school teacher, was afraid they would come to the school and take the vehicle and she would be embarrassed she went to the dealership and wrote a new contract paying an additional $3000.

I'm sure many people in this blog have experienced collection agancies that are apparently not the slightest bit interested in collecting the debt owed on a car. They never answer frantic calls of the debtor trying to work out a reasonable payment schedule or just trying to pay the whole amount.
This stinks of usury to me: charging too much interest for the debtor to repay. In this case "interest" is the difficulty of arranging fair settlement of the debt. Am I correct that it is illegal for a debt collection company to ignore the pleas of the debtor to repay? "Please leave a message and I will call you back: maybe"
I have a feeling this is very common. If you are a victim of this sort of dishonesty, I urge you to report the situation to your local authorities instead of suffering in silence. Don't hesitate to complain to your congressman either. This sort of swindle is all too common.
